The court ordered the administration of Derbent to provide an apartment to the orphan.

The administration of Derbent is obliged to provide an apartment out of turn to a graduate of the orphanage who has been on the housing needs register for ten years, the court ruled.

As reported by "Caucasian Knot", orphans from Dagestan periodically complain about violations of their housing rights. For instance, in early June, the story of orphan Magomedfazil Kurbetov caused a wide resonance, who, according to a resident of Makhachkala, had been sleeping on a bench in the city park for a long time. Kurbetov himself stated in a video that he has been forced to live on the street for seven years. After the publicity, officials in Makhachkala promised to provide him with the housing he is entitled to by law. The situation with providing housing for orphans in Dagestan is tense; in some municipalities, the number of those in need has more than doubled, acknowledged the head of the republic's government, Magomed Ramazanov, on July 31.

The Derbent City Court satisfied the claim of a local resident against the city administration, obliging officials to provide her with housing. The girl has been growing up without parental care since 2009 and was raised in an orphanage.

The orphanage graduate was registered as needing housing back in 2016, but over the past ten years, she has not received the apartment she is entitled to by law.

“In response to inquiries, it was reported that the girl is in queue number 156, and housing will be allocated as funds become available. The court reminded the defendant that the law does not provide for any queuing for orphans,” the press service of the Supreme Court of Dagestan reported.

The court's ruling clarifies that the general list of those in need of housing “is necessary only for budget planning and does not give the right to delay the issuance of apartments.”

“The lack of funding is a problem for local authorities, not for a citizen who has a guaranteed right to housing from the state. The court recognized the inaction of the administration as illegal and ordered the provision of a well-equipped residential space from the specialized fund to the girl out of turn,” the publication of the official Telegram channel states.

The court's press service noted that the decision has not yet entered into legal force. The administration of Derbent has not yet reported on its official resources whether it intends to challenge it.
