The court fined the applicant for the rally for fair elections in Krasnodar.
The Lenin District Court of Krasnodar found the "Yabloko" activist Kurban Magomedrasulov guilty of insulting the authorities and fined him 30,000 rubles for sending a notification to the Krasnodar city administration about holding a rally against election fraud at the end of September.
As reported by "Caucasian Knot", a video was published on September 30 with apologies from 19-year-old "Yabloko" campaigner Kurban Magomedrasulov, who submitted a notification about the rally against election fraud. He was detained near the Krasnodar city hall after the authorities refused to approve the rally. Friends of the activist said that Kurban agreed to appear in a video with "repentance" to be able to leave the police station.
During the voting in Kuban, reports of disputed situations at polling stations were received. For instance, on September 20, activist Vitaly Cherkasov complained that at polling station No. 2014 in Krasnodar, observers would have to examine marks on ballots from about 10 meters away. On September 19, observer Ekaterina Burdyukova called the police to the same polling station after she discovered a tenfold discrepancy between the number of records of early voters in the logs and the data submitted to the election commission.
Today, the court in Krasnodar found "Yabloko" activist Kurban Magomedrasulov guilty of insulting the authorities . Moreover, the protocol was drawn up due to an insulting message directed at a subscriber of one of the city’s Telegram channels, where comments discussed the news about problems with gasoline, reports "Horizontal Russia. 7x7".
"The hearing has concluded. I believe that the offense I committed does not fall under Article 20.1 part 3, under which I was tried today. I believe that my offense falls under Article 5.61 part 2 (insulting, that is, humiliating the honor and dignity of another person)," Magomedrasulov wrote today in his Telegram channel "Kurban. Diary of an Activist".
According to the activist, he also submitted a petition to the judge for a forensic linguistic examination to determine the nature of the offense and choose the appropriate article, but the judge refused to accept the petition. As a result, Magomedrasulov was found guilty and fined 30,000 rubles.
"I do not agree with the verdict and intend to appeal this decision - I will file an appeal. The court session was fully recorded by me on a dictaphone," his message states.
"Caucasian Knot" also reported that the court partially satisfied the claim to deprive the member of the TIK "Apsheronskaya" Vladimir Kozorog of his powers, who did not recognize the election results. Kozorog intends to file an appeal.
