Residents of the Lak district have achieved the right to compensation for the house destroyed by the flood.
The court in the Lak district of Dagestan recognized the family members of local residents as owners of a house destroyed during the spring floods after they provided receipts for utility payments and asked neighbors to give testimonies. This granted them the right to be included in the lists for receiving new housing.
As reported by "Caucasian Knot", residents of the areas affected by the spring floods in Dagestan had previously complained multiple times about refusals for payments, repeated inspections of houses, and the need to seek assistance through the prosecutor's office. For instance, a resident of the village of Tutlar in the Khasavyurt district Zumrut Ezhueva, who is raising five children alone, spoke about numerous trips to social protection authorities. Initially, one-time assistance was only allocated for four family members, excluding two children from the list. They managed to get their inclusion after contacting the prosecutor's office.
The lack of housing documents for many residents of Dagestan became one of the obstacles to receiving payments after the spring floods. By July 18, 728 lawsuits had been filed to recognize the right to use and own the affected houses, with courts issuing positive decisions in 46 of them. After registering property, residents could apply for social payments, one of the conditions of which remained the absence of other housing.
According to the case materials, the house of residents in the Lak district was completely destroyed during the spring floods – the walls and roof of the building collapsed. The object was recognized by the interdepartmental commission as lost and not subject to restoration. This granted the family the right to receive a state housing certificate.
However, the family could not receive the due compensation due to the lack of official registration of property rights in the Unified State Register of Real Estate (EGRN) at the time of the emergency regime introduction. This led the residents to appeal to the court, reported the press service of the Lak district court.
The court examined the testimonies of neighbors, extracts from household books, and utility receipts. The fact of residence and ownership of the property was proven on these grounds. The court recognized equal shares of property rights to the house for the family members. This granted them the right to be included in the lists for receiving new housing, reported the press service on October 20.
"Caucasian Knot" also reported that earlier residents of Adilyotar complained that payments for lost property only covered part of the losses, while housing certificates remained unissued. Pensioner Abdul Akhiev stated that after the flood, he had to completely demolish his house. The family also lost eight cows and agricultural machinery.
"They promised compensation for building houses, we are waiting for housing certificates. We are living with relatives," he explained.
A fellow villager of Akhiev, teacher Ayub, reported that the foundation of his house cracked after a day in the water. He received payments, but they did not cover all expenses: electrical appliances and pumps were damaged, and the harvest was lost.
The head of the village administration Abdulqadir Makhmaev acknowledged that residents are worried about the wait for housing certificates. He assured that local and republican authorities are taking necessary measures, and the documents for building new houses have gone through the Ministry of Construction.
Residents of Dagestan Ogni also spoke about the long wait for compensations. Zulfikar Abdulaev reported that his family was approved for one-time assistance, but payments for lost property have not yet arrived. The flooded house became uninhabitable, so the family had to rent an apartment in Derbent.
In Makhachkala, victims complained about the need to repair housing at their own expense. A resident of Uzornaya Street Rabadon stated that after a refusal, he reapplied, but did not receive a response.
