An orphan from Sochi has restored her housing rights.

The court in Sochi ordered officials to provide a local resident with housing, stating that she has the right to it as she is an orphan.

According to the case materials, the orphaned resident of Sochi filed a lawsuit in the Khosta District Court. The girl sought to obtain the housing she is entitled to by law. Despite being included in the list of orphans entitled to receive housing from the state and repeated requests, officials refused to provide her with an apartment due to her inherited share in another residential property.

The area of the inherited share was only 1.39 square meters. Subsequently, the girl gifted it to her brother, but this did not help her obtain housing, reported the Unified Press Service of the courts of the Krasnodar Territory.

"The area of the share that the girl later gifted to her brother was 1.39 square meters, which became an obstacle to recognizing the impossibility of living in this residential property," the press service reported today, according to Sochinews.

Considering the circumstances of the case, the court concluded that the resident of Sochi had not lost her right to receive housing from the state. The claim was granted, and the administration of Sochi was ordered to provide her with a well-equipped residential property, the statement said.

"Caucasian Knot" also reported that orphans in the Krasnodar Territory regularly face violations of their housing rights. On June 7, 2022, it became known about the initiation of a criminal case against the head of the Bryukhovetsky District. According to investigators, the district administration purchased 18 apartments for orphans, some of which turned out to be uninhabitable. Investigators also reported the purchase of housing at inflated prices and damage to the regional budget.

The issue of providing orphans with the housing they are entitled to is also relevant in other regions of southern Russia. On August 9, 2022, an orphan from Volgograd Darya Kulbachnaya reported that officials refuse to provide her with the well-equipped housing she is entitled to by law, citing a long queue and offering temporary options.

The reason that authorities refuse to provide orphans with housing, lawyer Sergey Ivashchenko previously linked to insufficient budget funding. "Questions need to be asked to parliamentarians about why this funding is so meager, why there are more than a thousand unfulfilled court decisions regarding orphans," he told a correspondent of the "Caucasian Knot."
