Kardashov's mother shared her hope for justice for her son.
The case of former Rosgvardiya officers Dukaev and Abdurashidov from the Supreme Court of Chechnya should be returned to the prosecutor for further investigation, human rights activists insist. This possibility has given the mother of the murdered pharmacist from Khasavyurt, Alexey Kardashov, a small hope for an objective investigation.
As reported by "Caucasian Knot", the cassation instance returned the case against former Rosgvardiya employees Aslan Dukaev and Bekhan Abdurashidov to the Supreme Court of Chechnya, emphasizing that the court representatives in Chechnya ignore the arguments of the victim's side and the prosecutor's office.
In the summer of 2023, the Gudermes City Court of Chechnya found former Rosgvardiya employees Bekhan Abdurashidov and Aslan Dukaev guilty of the illegal detention of Alexey Kardashov. They were sentenced to two years probation under the article on abuse of power. This sentence was overturned on appeal, and in June 2024, the Sheikh-Mansurovsky Court terminated the case against Abdurashidov and Dukaev due to the expiration of the statute of limitations for criminal prosecution.
The cassation instance canceled the appellate ruling in the case of Dukaev and Abdurashidov, as the representatives of the victim had filed a motion to return the case to the prosecutor, but the court that ruled to terminate the case did not assess it, explained a representative of the "Team Against Torture"*.
"The ruling was superficial. The refusal to satisfy the motion is unsubstantiated, meaning the court did not properly respond and did not study our motion to return the case to the prosecutor," he told a correspondent of the "Caucasian Knot".
The Deputy Prosecutor of Chechnya also refers in his submission to a number of procedural violations that were committed by the first instance court.
"But it should be noted that neither in the first instance court nor in the Supreme Court of Chechnya did the representatives of the Chechen Republic prosecutor's office advocate for the case to be returned to the first instance. The cassation submission from the prosecutor's office came only after the victim's side filed a cassation complaint in the Fifth Cassation Court of General Jurisdiction, which, in fact, accepted the arguments of this cassation complaint, partially satisfied it, and took into account the arguments of the cassation submission," the human rights activist said.
The "Team Against Torture"* expects that after the case is returned to the Supreme Court of Chechnya, the ruling of the Sheikh-Mansurovsky District Court to terminate will be overturned.
"The case will be returned to the first instance, where we still hope that the court will hear us, and the case will be returned to the prosecutor for additional investigation," explained a representative of the organization.
The mother of Alexey Kardashov Tsilya Yakubova, as before, considers this process against the law enforcement officers and the expected sentence for Said-Magomed Omarov to be a spectacle, but at the same time, she has gained hope for the possibility of an objective investigation into her son's case.
"I still say that this is a continuation of the spectacle, as for so many years we have not been able to achieve anything. The guys from the "Team Against Torture"* are trying, of course, thank them very much, but we are all ignored. But now I have some small hope that maybe something will change," Yakubova told a correspondent of the "Caucasian Knot".
At the court session in Chechnya on July 31, Said-Magomed Omarov, accused in the case of the murder of Alexey Kardashov, refused to testify, citing the Constitution. At subsequent sessions, Omarov also refused to provide significant information, stating that he was tired and could not remember anything. The human rights activist reported that the investigation ignores part of the evidence, and Kardashov's mother believes that Omarov is being made a "scapegoat". According to the mother, Omarov participated in the abduction of her son, but not in the murder, and the real killers will escape responsibility if Said-Magomed is convicted for the crime.
During the debates in the Gudermes City Court on September 25, the prosecution requested 10 years of imprisonment for Omarov. The next court session is scheduled for September 30: at it, the defendant will be given the last word, after which the court will go into deliberation to render a verdict.
