Tuapse gardeners have complained to the Constitutional Court about the seizure of plots by the authorities.
Residents of the dacha cooperative "Burevestnik" in the area of the village of Olginka in Tuapse have appealed to the Constitutional Court of Russia. They are asking the highest judicial authority to protect them from the seizure of plots that people have owned since the 1990s.
As reported by "Caucasian Knot", residents of the "Burevestnik" cooperative in the village of Olginka in the Krasnodar region recorded a video appeal to the President of Russia and the head of the Investigative Committee, in which they complained that the authorities of the Tuapse district and the prosecutor's office are seeking the demolition of 50 cottages in the village, with courts ruling in their favor.
The Constitutional Court of Russia will consider the appeal of the residents of the DPC "Burevestnik" from the Tuapse district, who are contesting the seizure of land plots and the demolition of cottages located on them. The gardeners believe that local courts did not take into account the legal position of the Constitutional Court in a similar case involving residents of Sochi in 2025, reports the publication "Morning South".
The mass seizure of land plots in the Krasnodar region was related to a case of fraud involving the lands of the Sochi National Park: 11,066 land plots were seized, including plots allocated by the authorities to large families, and then the courts began to deprive owners of their property rights to these lands en masse, according to a report by "Caucasian Knot" "The struggle of Sochi residents for lands in the national park". In January 2025, the Constitutional Court ruled that the authorities must either keep the land plot, which is located within the boundaries of the National Park, for its owner, or provide compensation if there is no evidence that the plot was acquired dishonestly.
In 2024, the Tuapse inter-district prosecutor's office filed a lawsuit against 54 residents of "Burevestnik". The supervisory authority demanded to transfer about 0.5 hectares of land to the state and demolish the cottages built on the plots as unauthorized constructions. According to the prosecutor's office, the territory is located in a sanitary protection zone of the resort and partially overlaps with forest fund lands.
The courts of the first and appellate instances supported the prosecutor's demands. In May 2026, the Krasnodar Regional Court upheld the decision, and in July, the Fourth Cassation Court refused to suspend its execution.
The gardeners insist that they should not be held responsible for violations committed by state and municipal authorities. According to them, the plots were purchased from the municipality, and the authorities subsequently changed the types of permitted land use, issued construction permits, and registered property rights in the Unified State Register of Real Estate.
Representative of the residents Ivan Brikulsky points out that the costs of demolishing one cottage can reach 3 million rubles. At the same time, he says, the owners' incomes are significantly lower than that amount. Additional concern for the gardeners is the execution of the demolition decision. According to them, on August 20, during the disconnection of utilities, employees were present on the territory who used force against one of the residents. They were also informed about the possible arrival of equipment for the dismantling of houses.
"Caucasian Knot" also reported that Sochi resident Alexander Batalin disagreed with the appellate court's decision regarding the ownership of the plot. The court did not pay attention to key facts, including that the sale of the plot was concluded on behalf of the deceased owner, he stated, expressing his intention to appeal the decision.
