The Supreme Court of Dagestan prohibited the construction of a cafe on pasture lands.

The lawsuit of the Ministry of Property of Dagestan to prohibit the construction of a cafe on a plot of two thousand square meters of pasture lands in the Kayakent district was satisfied by the Supreme Court of the Republic.

The Supreme Court of Dagestan overturned the decision of the Kayakent District Court regarding the use of pasture lands. The appeal against the decision was filed by the Ministry of Property of the Republic.

A citizen of Dagestan filed a lawsuit requesting to establish the boundaries of a plot of two thousand square meters for the construction of a cafe in the Kayakent district. The Ministry of Property of Dagestan opposed this, as the plot belongs to pasture lands, which are not intended for the construction of public catering facilities, reports RIA "Dagestan" on July 13.

The Kayakent District Court satisfied the citizen's claim; however, the Ministry of Property filed an appeal. The Supreme Court overturned the first instance decision and completely denied the satisfaction of the claim.

In Dagestan, the issue of settlements located on pasture lands remains relevant. In July 2022, the Constitutional Court of the Republic deemed it necessary to reclassify inhabited pasture lands to the status of settlement lands and legalize the settlements that have spontaneously formed on them. After that, more than 100 residents of the lowland areas (Kayakent, Babayurt, Kumtorkalin, Kizilyurt, and Karabudakhkent) held a meeting in Makhachkala. They demanded to revoke the decree, considering it a "legalization of land seizure".

Pasture lands are the property of Dagestan, have a special status, and are not subject to privatization, according to the law "On the Status of Pasture Lands in the Republic of Dagestan".
