Law enforcement has intensified pressure on entrepreneurs at the Makhachkala beach following the appeal to Shchukin.
After the appeal of entrepreneurs to the acting head of Dagestan, Fyodor Shchukin, law enforcement officers took several people to the station, issuing them a ban on trading at the "Oasis" beach. Appeals to officials have not yielded results, the owners of the trading points reported.
As reported by "Caucasian Knot", the owners of trading points at the Makhachkala beach "Oasis" recorded a video appeal to the acting head of Dagestan, Fyodor Shchukin, complaining that law enforcement officers do not allow them to work, as the court annulled the lease agreement of the previous tenants. The beach has fallen into a state of disrepair, and entrepreneurs are suffering losses, the authors of the appeal said. They requested to be allowed to work until the end of the resort season.
Entrepreneur Aryfa Kharisova told a correspondent of "Caucasian Knot" that she and other owners of trading points at the beach worked under a sublease agreement with a tenant whose lease was annulled by the court for reasons unknown to them. Now the trading points, cafes, canopies, and gazebos have been removed, and entrepreneurs are not allowed to work, she noted.
The current legal status of the land plot after the annulment of the lease by the subtenant is unknown, and no alternative options for formalizing the right to conduct business were offered, Kharisova reported. According to her, officials send entrepreneurs from one department to another.
"We went to the city administration. They directed us to the Ministry of Dagestan, saying that the beach belongs to them, and we need to negotiate there and obtain permission to trade. Two of our representatives spoke with the minister, who said: 'We are not against it, but we cannot give instructions to law enforcement agencies.' Then we wrote a collective appeal to the acting head of Dagestan, Fyodor Shchukin. The administration accepted it for consideration but sent it to the Ministry of the Republic. We went to their lawyer, who said that this property does not belong to them but to Rosimushchestvo. We went there and submitted an appeal from the collective. There have been no results so far; apparently, we are not needed by anyone," says Aryfa Kharisova.
"There are 24 of us, most registered as individual entrepreneurs, we are ready to pay rent and all taxes, why are we not allowed to work until the end of the summer season?"
Meanwhile, she said, police and district officers regularly come to the beach, prohibiting entrepreneurship in the area without showing a court order or other documents. On July 7, several people were taken to the station and issued a ban on commercial activities at the beach.
"There are 24 of us, most registered as individual entrepreneurs, we are ready to pay rent and all taxes, why are we not allowed to work until the end of the summer season? Meanwhile, the beach itself is operating; it is not closed. But trading points are not allowed to operate. People are swimming there, but there are no lifeguards. Previously, the tenant hired a group of lifeguards, a cleaner, and had a contract for garbage disposal. Entrance to the beach, parking, toilets, and showers were
free, we paid for water and lighting," says Kharisova.
Rospotrebnadzor of Dagestan reported that by the decree of June 4, 2026, "On the introduction of restrictive measures prohibiting swimming in the coastal strip of the cities of Makhachkala and Kaspiysk," swimming at the suburban beach "Oasis" is prohibited due to non-compliance with hygiene standards for water in the sea.
Lawyer Ali Aliyev told a correspondent of "Caucasian Knot" that, according to established practice, all sublease agreements of entrepreneurs with the tenant who lost rights are automatically terminated, leaving traders without a legal basis for conducting business on this territory.
"If entrepreneurs were not involved in the case of the termination of the lease agreement, they can file an appeal against the court's decision if it violates their rights. There is an option to file a civil claim against the former tenant for damages. The only legal way for entrepreneurs to continue working at the beach is to conclude a new contract on a paid basis with a new owner or tenant," the lawyer explained.
At the same time, he emphasized that if they continue to trade without a contract, their activities may be classified as illegal, which entails administrative responsibility, and in some cases, criminal liability for usurpation or illegal entrepreneurship.
Regarding the legality of the actions of law enforcement in blocking access to trading facilities, the lawyer noted that in the presence of court acts ordering the dismantling or cessation of activities of specific entrepreneurs, traders have no legal grounds for placing trading facilities on disputed land. In their absence, hindering lawful entrepreneurial activity constitutes an administrative offense under the Administrative Offenses Code of the Russian Federation.
Lawyer Magomed Abakarov told a correspondent of "Caucasian Knot" that the beach "Oasis," located between Makhachkala and Kaspiysk, has existed since Soviet times and was previously called "Suburban."
According to him, the territory of this beach was once affiliated with structures belonging to the former head of Makhachkala, who is serving a life sentence, Said Amirov.
"Nearby the territory of this beach are the facilities of the company 'Makhachkalinskoye Vzmore,' and not far away, the construction of the satellite city of Makhachkala 'Lazurny Bereg' was planned. It is quite possible that the legal status of these lands has not yet been determined, which is why contracts with entrepreneurs are being terminated. The chances for a favorable outcome will arise only if a new owner of the land is established, then it will be possible to conclude lease agreements. As for the actions of law enforcement preventing entrepreneurs from working, it is necessary to officially request a reasoned justification for their actions. The document should specify the specific legal acts on the basis of which such a decision was made," the lawyer believes.
"Lazurny Bereg" is known as one of the ambitious projects of the former mayor of Makhachkala, sentenced to life imprisonment, Said Amirov.
In 2005, a company close to Amirov, "Makhachkalinskoye Vzmore," initiated the project to build a satellite city of Makhachkala "Lazurny Bereg" on the Caspian coast, as stated in the biographical reference about Said Amirov.
In September 2022, the Kirov District Court of Saratov, in the first instance, satisfied the claim of the Prosecutor General's Office of Russia for the seizure of property of relatives of former Makhachkala mayor Said Amirov and people associated with him for the benefit of the state. The value of the property complex seized in favor of the state amounts to more than five billion rubles, including 356 real estate objects, of which 173 are land plots.
According to the court, it was Said Amirov who "was the initiator and beneficiary of the privatization of the named joint-stock companies and their alienation into private ownership." According to the court's version, Amirov indirectly controlled, through trusted persons - relatives and affiliated persons - including the company "Makhachkalinskoye Vzmore."
