A conscript from Krasnodar Krai reported that the military registration and enlistment office illegally upgraded his fitness category, despite his asthma. His lawyer claimed the category was changed illegally and filed a lawsuit.
The draft board in Krasnodar Krai arbitrarily changed a conscript's fitness category, Kondrat Gorishniy, his lawyer, told a "Caucasian Knot" correspondent on June 7.
Even with a confirmed diagnosis of bronchial asthma, even mild cases, fitness category A1 cannot be assigned, as it contradicts the direct content of Article 52 of the Schedule of Diseases, according to which conscripts with such a condition are assigned category B.
"My client is 23 years old; he has been diagnosed with bronchial asthma since the age of nine. According to available medical documents, the illness is not accidental or one-off, but is confirmed by many years of medical observation, visits to specialized specialists, examinations, treatment, and repeated inpatient treatment. He underwent medical examinations several times at the direction of the military commissariat, the last time in May 2026. The diagnosis was confirmed. Despite the above, he was examined by the draft board, and his fitness category was changed from category B ("limited fitness for military service") to A1 ("fit for military service, no pathologies or diseases at the time of examination"). According to Article 52 of the Schedule of Diseases, approved by the Regulation on Military Medical Examination, he is considered a citizen examined under Column I of the Schedule of Diseases (citizens upon initial registration for military service, conscription for military service, citizens who have not completed military service). Consequently, in the presence of a confirmed diagnosis of bronchial asthma, even of a mild degree, fitness category A1 cannot be established, since it contradicts the direct content of Article 52 of the Schedule of Diseases, according to which conscripts with such a disease are assigned category B,” the lawyer emphasized.
The conscript himself, on condition of anonymity, told a "Caucasian Knot" correspondent that initially he was assigned category G (temporarily fit for military service).
"The last time I was examined at a clinical hospital, and based on the results, I should have been assigned category B. However, I was suddenly sent "for clarification" to a certain distribution point, explaining that more qualified doctors would be there," he noted.
They did not engage in dialogue - there was only a monologue on their part.
However, according to the young An allergist examined the man instead of the pulmonologist who was supposed to examine him. "As a result, the military medical commission, citing his document, even though I asked to see the previous documents, changed my category to A. They didn't engage in dialogue—they only offered a monologue. I filed a complaint against this decision, and twenty days later they responded: 'Go to court, we can't overturn anything,'" he said. Gorishniy noted that documents on the progress and results of the examination have been requested from the military commissariat, and complaints have been sent to the prosecutor's office and the regional Ministry of Health. "There have been no responses yet. An administrative lawsuit has also been filed demanding that the draft board's decision be declared illegal. "The lawsuit has been accepted for proceedings by the court," the lawyer stated.
The first court hearing in this case will take place on June 19.
Previously, "Caucasian Knot" reported that last August, the Nalchik City Court ordered the Russian Ministry of Defense to pay compensation to Eldar Pshibiyev, who was called up for service despite a diagnosed heart defect. Pshibiyev served eight months and was hospitalized. The military registration and enlistment office filed an appeal.
