Residents of the collapsed high-rise building on Narimanov Street in Rostov-on-Don have filed an appeal with the Supreme Court of Russia against the cassation court's decision to overturn the acquittal of former head of the Voroshilovsky District, Viktor Berezhnoy. The Supreme Court has decided to review the case.
As reported by "Kavkazsky Uzel," on April 28, the former head of the Voroshilovsky District administration, Viktor Berezhnoy, was acquitted of negligence. The judge concluded that the official's actions did not constitute a crime. Residents of the building agreed with the court's position and demanded that the real culprits be punished. The prosecutor's office appealed the verdict, but the appellate court upheld it. However, the cassation court remanded Berezhnoy's case for a new trial.
On January 27, 2024, the wall of a five-story building on Narimanov Street began to collapse, evacuating 95 people. Later, the first entrance to the building collapsed. Viktor Berezhnoy was charged with negligence in connection with the collapse: according to investigators, he knew the building had been declared unsafe in 2020 but failed to prevent the emergency. At the same time, the residents themselves do not consider Berezhnoy guilty and emphasize that he was the first official to visit the residents after the collapse, and it was he who decided to evacuate them.
The Supreme Court of Russia has requested the release of Viktor Berezhnoy's case regarding the collapse of a five-story building on Narimanov Street, 161.ru reported on May 23.
The complaint to the Supreme Court was filed by the residents of the building themselves, their lawyers, as well as Rostov City Duma deputy Natalya Oskina and lawyer Irina Yakymiv.
According to Natalya Oskina, the Supreme Court found errors and violations of the law in the cassation decision, and therefore the case will be retried. "We hope that the Supreme Court has confirmed Berezhnoy's innocence and will overturn the cassation court's decision finding him guilty," the publication quotes her as saying. She also said that the complaint was being reviewed for quite a long time, and then the case file itself was requested.
The hearing is scheduled for July 8th.
