Single father from Volgograd region achieves mitigation of sentence for leaving unit
The Southern District Military Court replaced the five-year sentence for unauthorized abandonment of a unit for a father of many children, Ruslan Zhadaev, with a suspended sentence. The court explained the mitigation of the sentence by an incorrect interpretation of the law.
As "Kavkazsky Uzel" wrote, a father of many children, Ruslan Zhadaev was sentenced to five years for unauthorized abandonment of a unit, he appealed the sentence. His children are in a social rehabilitation center, if the appeal is not satisfied, they will be placed in an orphanage.
Ruslan Zhadaev is 47 years old. After getting married, he and his wife moved from Volgograd to the village of Fyodorovka, Zhirnovsky District, Volgograd Region. He worked as a cattleman. He raised four children. In 2022, he volunteered for the SVO. In the combat zone, Ruslan served as a shooter in the Bars detachment. Due to health problems, he returned home, but in 2023 he again signed a contract with the Russian Armed Forces. He has problems with his spine (his arm is paralyzed) and with his knees - he suffers from a torn meniscus in both knee joints. He was treated in a hospital, but he could not have surgery because he found out that his wife had abandoned the children and left.
The sentence of a single father of many children, Ruslan Zhadaev, sentenced to 5 years of imprisonment in a penal colony for unauthorized abandonment of his unit, has been changed. The hearing lasted about six hours, said lawyer Evgeny Dereza.
Ruslan's children came to court with him. "When we heard that the real term had been replaced with a suspended sentence, Ruslan almost cried. And the children burst into tears, of course, from joy. Now their dad will stay with them, and there will be no orphanage," the publication "Height 102" quoted him as saying.
According to the case file on the website of the Southern District Military Court, the hearing of Zhadaev's appeal took place on August 29.
"The guilty verdict was changed without changing the qualification," the case file says. The basis for this decision is an incorrect interpretation of the criminal law.
