In Sochi, court legalizes unsanctioned building in GNP "Kommunalnik"

Members of the garden non-commercial partnership (GNP) "Kommunalnik" and the Sochi Mayor's Office have failed to challenge the decision, according to which the unsanctioned construction in the territory of the GNP was declared legal. The expert opinion about the building states it does not cause any inconveniences for members of the GNP "Kommunalnik".

The "Caucasian Knot" has reported that in May, members of the GNP "Kommunalnik" asked the Mayor of Sochi to stop the construction of an apartment building in the territory of their GNP. The Sochi Mayor's Office recognized building as unsanctioned and demanded to demolish it. The court of first instance refused in demolition of the building, and the Sochi Mayor's Office appealed against the court's decision.

Today, the Krasnodar Regional Court has legalized the building under construction. The members of the GNP "Kommunalnik" intend to file a cassation against the court's decision.

"This is a partnership of garden amateurs. The assigned purpose of the land is gardening. The land is assigned for growing of vegetables and fruits, ploughing and sowing, and not for construction of apartment buildings under decisions of judges, who completely ignore the law and the rights of gardeners," notes Alexander Baturin, who represents the interest of a third party.

According to Alexander Boichenko, the head of the Sochi branch of the Moscow Bar Association, in Sochi, there is a common practice to legalize unsanctioned constructions through courts.
