Defence of Rustam Gabibov establishes his whereabouts

Rustam Gabibov, accused of killing a resident of Dagestan, was transferred for several days from SIZO-1 (pre-trial prison) of Nalchik to the IVS (temporary detention centre) of the capital of the KBR, after which he was brought back, said his advocate Sapiyat Magomedova.

The "Caucasian Knot" has reported that law enforcers detained residents of Derbent Gamlet Kelbisov and Rustam Gabibov on December 26, 2014. They are accused of involvement in a murder committed in Moscow in 2010. Defendants told their advocates that they had been tortured. On August 7 the defence of Gabibov complained about non-admission to the defendant, who, according to advocates, was taken away from SIZO-1 of Nalchik to some unknown place.

Sapiyat Magomedova finally managed to meet her client, for whom his transfer from SIZO to IVS, according to the advocate, was a complete surprise. "He complained that at the IVS he received no medication that he needs for his illness (he was diagnosed with hepatitis C), and wasn’t allowed for a walk," said Magomedova.

She pointed out that immediately after the detention of Rustam Gabibov and Gamlet Kelbisov, their advocates were not given an opportunity to meet their clients; and since Magomedova entered the case in late January, she has to spend a lot of time looking for his client, who "is constantly transferred to Yessentuki or Vladikavkaz; now, he was brought to Nalchik."

"In this case, we see an obstruction to advocates in performing their professional duties," Magomedova said, describing the situation as a violation of Gabibov's and Kelbisov's right to defence.
