Spasskaya and Batrakov’s attorneys in Sochi filed a cassational appeal against the verdict of the court

On July, 30, attorneys Gennady Kalyshev and Vitaly Shipulin filed a cassational appeal against the verdict on Elena Spasskaya and Mikhail Batrakov’s case to juridical board for criminal cases of Krasnodar regional court.

On July, 11, the court in Sochi acknowledged guilty of swindle on an especially large scale Elena Spasskaya, Director of municipal unitary enterprise “Directorate of trade gallery operating” and entrepreneur Mikhail Batrakov. Elena Spasskaya was sentenced to four and Mikhail Batrakov to six years of custody.

The attorneys consider that judge of the Central court of Sochi Sergey Martynenko ignored the arguments and evidence for the defense proving Spasskaya and Batrakov’s innocence just rewriting the investigator’s indictment. In the attorneys’ opinion, the charge was based on fabrication of an allegedly committed crime.

The attorneys point out in their appeal that the investigation was conducted with violations of the Code of criminal procedure of the Russian Federation which resulted in making knowingly innocent people criminally liable and an unjust sentence.

Elena Spasskaya and Mikhail Batrakov’s attorneys ask to recall the verdict of the Central court of Sochi on the criminal case No 1-208/12 dated July, 11, 2012, eliminating criminal proceedings for the absence of crime in the defendants’ actions.
